Nadler, Lofgren Statement on SCOTUS Decision Allowing Trump Administration's "Public Charge" Rule

Washington, January 27, 2020

Washington, D.C. – Today, the Supreme Court stayed a judicial order preventing the Trump Administration from implementing its controversial "public charge" rule.  This rule makes it harder for working families seeking family reunification through our current immigration system.  In response, House Judiciary Committee Chairman Jerrold Nadler (D-NY) and Immigration and Citizenship Subcommittee Chair Zoe Lofgren (D-CA) released the following statement:

"We are very disappointed to learn of the 5-4 decision from the Supreme Court allowing the public charge rule to be implemented pending further court action.  As numerous federal courts around the country have recognized, this rule is a bald attempt by the Trump Administration to rewrite our immigration laws without congressional approval.  The rule upends over a hundred years of settled interpretation by the legislative, executive, and judicial branches.  The lower court’s injunction provided an important safeguard against implementation of this unlawful rule.

"The Court should always protect and defend the separation of powers enshrined in our Constitution.  We are hopeful the Court will eventually reach that conclusion, even if it failed to do so today."
